ISOweld is operated by Damien Crane (ABN: 50 803 660 487), a sole trader based in New South Wales, Australia. This Disclaimer explains the limitations that apply to the use of the ISOweld website, software, kiosk tools, AI functions, registers, dashboards, document systems, job tracking tools, and related services available through https://isoweld.damocrane.com (the “Platform”). This page should be read together with the Terms of Use, Privacy Policy, End-User License Agreement (EULA), Data Security Policy, Third-Party Services & Integrations, Acceptable Use Policy, Intellectual Property Statement, Data Processing Agreement, and Security & Compliance.

1. General Information Only

ISOweld is designed to assist businesses with record control, compliance workflows, document handling, operational visibility, and traceability. The Platform provides organisational tools and informational outputs only. Nothing on the Platform constitutes legal advice, engineering advice, tax advice, workplace health and safety certification, professional quality assurance certification, or any other regulated professional service.

2. No Guarantee of Compliance

Use of ISOweld does not, by itself, guarantee compliance with:

  • ISO 9001 or any quality management standard;
  • ISO 3834 or any welding quality requirement;
  • Australian workplace health and safety laws;
  • Chain of Responsibility requirements;
  • industry-specific legislation, codes, or contractual obligations;
  • any customer, principal contractor, auditor, regulator, or insurer requirement.

Users remain solely responsible for verifying requirements, implementing internal procedures, maintaining documented evidence, and obtaining independent professional advice where required.

3. AI and Automated Outputs

ISOweld may include AI-assisted features, automation tools, suggested actions, reminders, search results, summaries, or generated text. These outputs are provided for convenience only and may be incomplete, inaccurate, out of date, or unsuitable for your specific circumstances.

  • AI outputs must be independently reviewed before being relied upon.
  • Generated content must not be treated as professional advice or regulatory approval.
  • Users are responsible for validating all data, dates, expiry records, and compliance decisions.

4. User Responsibility for Records and Decisions

You are solely responsible for:

  • the accuracy, completeness, and legality of data entered into ISOweld;
  • documents uploaded, stored, linked, shared, or exported through the Platform;
  • decisions made based on dashboard information, alerts, AI suggestions, reports, or search results;
  • ensuring employee records, qualifications, certifications, inductions, and maintenance records remain current;
  • ensuring access permissions are correctly configured within your organisation.

5. Third-Party Services

Some ISOweld functions may depend on third-party services such as Microsoft SharePoint, OpenAI, Google Maps Platform, ClickUp, and WorkflowMax2. Those services are operated independently and are subject to their own terms, privacy policies, security controls, service levels, and outages. Damien Crane does not control those systems and does not warrant their continued availability, performance, or suitability.

6. Availability and Service Interruptions

While reasonable efforts may be made to maintain availability, ISOweld is provided on an “as is” and “as available” basis. The Platform may be unavailable, degraded, delayed, or interrupted due to maintenance, internet failures, software defects, device issues, third-party outages, cyber incidents, hosting issues, or events beyond reasonable control.

7. No Warranty

To the fullest extent permitted by law, Damien Crane disclaims all express or implied warranties in relation to ISOweld, including implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, non-infringement, uninterrupted access, or error-free operation.

8. Limitation of Liability

To the fullest extent permitted by Australian law, Damien Crane, trading as ISOweld, is not liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive loss, including loss of profits, revenue, opportunity, goodwill, business interruption, data loss, document loss, certification failures, audit findings, legal exposure, or regulatory action arising out of or in connection with:

  • use of or inability to use the Platform;
  • reliance on AI responses, alerts, reminders, search results, or exported data;
  • user-entered errors, omissions, outdated information, or false records;
  • third-party outages, API failures, or external data handling practices;
  • security incidents, cyberattacks, credential sharing, or user negligence;
  • data storage, access, permissions, retention, or deletion issues involving Microsoft SharePoint or other connected services;
  • misuse of the Platform or breach of any policy or agreement.

9. Governing Law

This Disclaimer is governed by the laws of New South Wales, Australia. Any dispute relating to this Disclaimer or your use of ISOweld will be subject to the courts of New South Wales unless another dispute mechanism applies under a separate written agreement.

10. Changes to This Disclaimer

We may update this Disclaimer at any time. Any updated version will be published at https://isoweld.damocrane.com/disclaimer.php with a revised effective date. Continued use of ISOweld after publication of an update constitutes acceptance of the revised Disclaimer.
